Syrian activists say 65 bodies found in Aleppo

(AP) ? The bodies of at least 65 people, some with hands tied behind their backs, were found in Syria's northern city of Aleppo Tuesday as the government and rebels trying to overthrow it blamed each other for the latest mass killing.

Also Tuesday, a bomb wounded former legislator and once governor of the central province of Hama, Abdul-Razzak Qtini, as he was in his car, the Britain-based Syrian Observatory for Human Rights and a neighbor of Qtini said. The neighbor, who spoke on condition of anonymity for fear of reprisals, said Qtini is receiving treatment in a Damascus hospital.

The bodies, almost all of men in their 20s and 30s, were discovered in the contested neighborhood of Bustan al-Qasr, the director of the Britain-based Observatory for Human Rights, Rami Abdul-Rahman said. Intense clashes between rebels and government troops have raged in the district since opposition forces launched an offensive on Aleppo in July.

Abdul-Rahman said the identities of the dead were unknown, and it was not clear who was behind the killings or when they occurred. A government official told The Associated Press in Damascus that the dead were residents of Bustan al-Qasr who were kidnapped and later killed.

Syrian state TV said the men were killed by members of Jabhat al-Nusra, an al-Qaida-linked group that the Obama administration has labeled as a terrorist organization. It said the men were killed after they demanded members of the group to leave their areas.

Another activist group, the Local Coordination Committees, put the number of bodies found at 80. It blamed government forces for the killing.

Such exchanges of accusations over killings have been common in Syria since the country's conflict began in March 2011. With lawlessness and joblessness now rife in many areas, kidnappings for ransom are not uncommon.

An amateur video posted online showed dozens of bodies placed in rows on the ground and wrapped in blue blankets. A crowd of men, many covering their noses with scarves, walk among the dead, apparently trying to identify them.

A voice in the background says "number them," while another says "pray for them." At one point, a man stops at a body and breaks down into tears, shouting: "he's my brother."

The video appeared genuine and corresponded to other AP reporting on the events depicted.

The Observatory said a total of at least 160 people were killed in Syria Tuesday, while the LCC put the figure at 162. They numbers included the bodies of the men found in Aleppo.

The violence came a day ahead of a donors conference for the Syrian opposition headed by U.N. Secretary-General Ban Ki-Moon in the oil-rich Gulf state of Kuwait.

In Washington, President Barack Obama authorized an additional $155 million in humanitarian aid for the Syrian people Tuesday, as his administration grapples for a way to stem the violence without direct U.S. military involvement.

The fresh funding brings the total U.S. humanitarian aid to Syria over two years to $365 million, according to the White House. Officials said the money was being used to immunize one million Syrian children, purchase winter supplies for a half million people, and to help alleviate food shortages.

The U.S. has long called for Syrian President Bashar Assad to leave power and says the fall of his regime is inevitable. In addition to the humanitarian aid, the White House has also ratcheted up economic sanctions on Assad's regime and recognized the rebel-led Syrian Opposition Council as the legitimate representative of the Syrian people.

Also, EU humanitarian aid Commissioner Kristalina Georgieva said the EU committed another 100 million euros ($134 million) in help, bringing the overall EU total so far to 360 million euros.

Earlier in the day, Syrian rebels stormed a government intelligence complex in the oil-rich east of the country, freeing at least 11 people held in a prison at the facility, activists said.

After five days of heavy clashes around the intelligence compound in the city of Deir el-Zour, rebels finally overran the complex early Tuesday, the Observatory said. It was not immediately clear whether those freed from the compound's prison Tuesday were fighters or activists.

The activists said the compound was run by the Political Security Department, one of Syria's four most powerful intelligence agencies.

Amateur videos showed rebels raising an Islamic flag on top of the three-story building as fighters carted away rifles and boxes of ammunition.

Deir el-Zour has been the scene of heavy fighting since the uprising against Assad began in March 2011. The province, which goes by the same name as the city, is located along Syria's border with Iraq and includes several oil installations that the rebels have repeatedly targeted.

The aid group Doctors Without Borders said last month that government forces are shelling and bombing Deir el-Zour almost daily. It said tens of thousands of Syrians, many of them wounded, remain trapped in the city.

Also Tuesday, regime warplanes also carried several airstrikes on rebel positions in restive towns and villages around Damascus, including eastern Ghouta and Yalda, the Observatory said. The group relies on reports from activists on the ground.

After capturing several major army bases and government outposts, the rebels control large swathes of land in northeastern Syria. Assad's troops, however, continue to hold a tight grip on the capital after nearly two years of conflict.

The areas on the capital's doorstep have been rebel strongholds since early on in the revolt. In recent months, the rebels have used them as a base from which they have been trying to push into central Damascus, the seat of Assad's power.

Back on the front line in Aleppo, a veiled female sniper who identified herself as Givara told the AP that when she decided to fight against Assad's troops people used to tell her that it would be difficult as a woman.

"No it's not difficult ... I want to defend my life," she said, adding that her husband is proud of her and that she was fighting because she didn't want to see her children reduced to "pieces of flesh" by government attacks.

Is it possible for children to outgrow autism?

Autism has always been considered a lifelong diagnosis, but a new study might just refute that claim.

?

According to a study published recently in the?Journal of Child Psychology and Psychiatry, some young children who were diagnosed as autistic might outgrow both their symptoms and their diagnosis as they get older. The study, funded by the National Institutes of Health included children, teens, and young adults who were diagnosed as autistic as children but then moved off the autism spectrum as they grew older. ?

?

For the study,?Dr. Deborah Fein from the University of Connecticut and her research team evaluated 34 children who had been diagnosed with autism in early childhood as well as 34 other children in their classes at school. These children were then compared with?another group of 44 children who were the same age and sex and had the same non-verbal IQ scores but were diagnosed as having "high-functioning" autism, in other words, they were less severely affected by their condition.

?

Using both cognitive and observation tests, researchers found that children who were originally diagnosed as autistic no longer had distinguishable symptoms of the condition. These children showed no sign of problems with language, face recognition, communication or social interaction.

?

So, did these children outgrow autism? It's possible, but researchers urge caution when interpreting these results. Another possibility is that the children had learned how to expertly compensate for their autistic symptoms.

?

In either case, it's potentially good news for children who are diagnosed with autism, and the families who love them.

Multiple Sclerosis Hands

I was going to title this post ?MS Spills? but I realize that when multiple sclerosis affects the hands it?s more than just spills which can be an issue.

A hot cup of coffee in my MS hands should be considered a weapon of mass destruction! Between wonky gait, tremors in my arms, when I?m trying to hold something, or if I?ve lost feeling all together, point A to point B seems to be a few laps around the alphabet. That my left side is weaker than my right ? thus my right hand holds my cane or my forearm crutch ? lends an air of obstacle course to many of my household excursions.

I can sometimes have great difficulty typing due to the way MS has scraped up my spinal cord. And the idea of holding something precious ? like an antique or, heaven forbid, a baby! ? is just not something I want to do anymore for the terror of a grip hiccup.

Funny, now that I think about it, that I had just (about 3 months prior) taken up viola lessons when I was diagnosed with MS. That beautiful instrument was sold back to the kind dealer who refunded the full price I?d paid.

They say that?s it?s our opposable thumbs that make us the beings that we are. What happens then those thumbs just don?t do what the human at the top of their chain of command asks of them?

The debate on same-sex marriage lacks context because its promoters have failed to take into account the equal rights already established in New Zealand law for same-sex couples.

Everyone remembers the passing of the Civil Unions Act in late 2004 because of the publicity it generated. The Civil Unions Act was followed by a companion Relationships (Statutory References) Act in early 2005 ? the Relationships Act. It was passed by Parliament without fanfare and little publicity. It has therefore been missing from this debate because its purpose and legal effects are largely unknown to New Zealanders. Yet it is of crucial importance.

So what did the Relationships Act do? It amended more then 150 acts of Parliament to add, after every reference to ?marriage?, the words ?civil union and de facto? so there would be a complete and perfect legal equality between marriage, civil unions and heterosexual or homosexual de facto relationships. It means all couples, in any of these relationships, have the same rights under New Zealand law, with the possible exception of the adoption law.

This is a valid argument?against?same sex marriage. It is not one I agree with but it is a better argument than Colin Craig?s views that people choose to be gay.

Gordon Copeland is a former MP who was in Parliament in 2004-2005 when the Civil Unions and Relationships (Statutory References) Acts were passed. He opposed both.

This is what amuses me. You vote?against?bills to give same sex couples any legal recognition at all, and then use the fact you were defeated as an argument for why the law is now great and no further changes are needed.

It?s a bit like voting against women getting the vote, and then once you lose that vote arguing women don?t need to be able to stand for Parliament also because they have the vote, and that is what matters.

Hi

A friend of mine in considering going on some sort of juice/detox/raw food diet. I think it's one you get the juices delivered and pay far too much for. I told her that I don't think it's very healthy as a lot of it is fruit so must have too much sugar and not enough protein, if there's even any. She seems to have lots of information telling her that every now and again it's really good to get rid of toxins. Just wondering what your opinions are?

Gay Marriage Opponents Cite Dubious Left-Wing Legal Argument ...

On March 26, the Supreme Court will hear oral argument over whether California?s Proposition 8, the voter initiative which banned gay marriage in that state, violates the Equal Protection Clause of the 14th Amendment.

In the brief they submitted to the Supreme Court yesterday, Prop. 8?s supporters cloaked their case against gay marriage in the principles of states? rights, arguing that California should be permitted to ban same-sex unions without interference from the federal courts. ?Our federal system of government is designed to permit a diversity of approaches to difficult and uncertain social issues,? the brief states, ?and the democratic process regarding marriage that is unfolding throughout the Nation shows the genius of that system at work.?

At first glance, that argument appears tailor-made to appeal to conservative and libertarian advocates of federalism. Unfortunately, the Prop. 8 defenders also base their case on a dubious left-wing legal theory that cuts against the very idea of limited government. Immediately after the statement quoted above, the Prop. 8 supporter's brief quotes from Justice Louis Brandeis? famous dissent in New State Ice Co. v. Liebmann (1932), where Brandeis wrote, ?it is one of the happy incidents of the federal system that a single courageous state may, if its citizens choose, serve as a laboratory; and try novel social and economic experiments without risk to the rest of the country.?

Don?t let these words fool you. Brandeis? goal was the expansion of state power at the expense of individual rights.

At issue in New State Ice Co. was a 1925 Oklahoma regulatory scheme that granted monopoly powers over the manufacture, sale, and distribution of ice to a select group of companies. The law effectively outlawed competition by requiring any would-be entrepreneur that wanted to enter the ice business to first provide ?competent testimony and proof showing the necessity? of his business plan to state officials. Needless to say, there was no legitimate public health, welfare, or safety justification for this infringement on the right to earn a living. And predictably, the state regulators were working in cahoots with the state-sanctioned ice monopoly to eliminate would-be competitors.

What prompted Brandeis to spin this naked act of protectionism as a ?courageous state...experiment?? Remember that Brandeis got his start in the Progressive movement of the 1890s, where he lobbied on behalf of vast regulatory powers and urged the courts to give second-class treatment to those constitutional rights he didn?t believe to be worthy of respect. In fact, in a letter to Felix Frankfurter, Brandeis even privately advocated the wholesale repeal of the 14th Amendment due to the limits it placed on state power.

Supporters of limited government should be wary of any legal argument that cites Brandeis? dubious ode to untrammeled state authority.

Indeed, consider how Brandeis? words were utilized in another recent high-profile Supreme Court case. When Chicago went before the Court in 2010 to justify its handgun ban and other elements of its restrictive gun control regime in McDonald v. Chicago, city officials cited Brandeis in defense of their infringement on the right to keep and bear arms. ?Firearms regulation is a quintessential issue on which state and local governments can ?serve as a laboratory; and try novel social and economic experiments without risk to the rest of the country,?? the city argued. Chicago officials should therefore be permitted ?the greatest flexibility to create and enforce firearms policy.?

The Supreme Court thankfully rejected this sweeping assertion of regulatory power.

Federalism is a bedrock American principle, but that does not mean that state governments enjoy free rein to ?experiment? on their citizens in violation of the Bill of Rights and the 14th Amendment. It?s time to stop invoking Brandeis and instead start reviving the eloquent words of Justice George Sutherland, who penned the majority opinion striking down the Oklahoma monopoly in New State Ice Co. ?In our constitutional system,? Sutherland wrote, ?there are certain essentials of liberty with which the state is not entitled to dispense in the interests of experiments.?

Djokovic getting the hang of winning in Australia

MELBOURNE, Australia (AP) ? Novak Djokovic is really starting to get the hang of how to handle himself at the Australian Open.

An expression often used Down Under ? "Keep your shirt on" ? is designed to discourage anyone from becoming unnecessarily overexcited.

Djokovic took it literally after his 6-1, 4-6, 6-1, 6-4 win Tuesday night over fifth-seeded Tomas Berdych, advancing to the semifinals at an 11th consecutive Grand Slam tournament.

The 2-hour, 31-minute victory took exactly half the time of his five-set, fourth-round win two nights previously against Stanislas Wawrinka. In the early hours of Monday morning, Djokovic ripped his sweat-drenched shirt off and flexed his muscles, mimicking his victory celebration after the 5:53 victory over Rafael Nadal in the 2012 Australian Open final.

That was acceptable at the time to the Rod Laver Arena crowd, which was still abuzz at 1:40 a.m. following five sets of high-level tennis.

After the Berdych match, however, he realized there was no need to raise the roof. Djokovic calmly pumped his fist once and walked to the net; he later joked about the ice baths he'd taken in between matches on the advice of local hero Lleyton Hewitt.

"It was a great performance. I was hoping to have a shorter match ... just not to go over 5 hours," Djokovic said, in a comparatively subdued mood after a considerably more routine victory. "It's always going to be tough against Tomas; he's an established player. He has a big game, big serve. He can compete against anyone on any surface."

In the semifinals, Djokovic will meet No. 4-seeded David Ferrer.

Ferrer survived a quarterfinal battle with fellow Spaniard Nicolas Almagro. Almagro had three chances to serve for the match, but Ferrer broke each time.

A usually mild-mannered pro, Ferrer showed his aggression at times when he threatened to spike his racket and even smashed his water bottle in the changeover after he'd dropped serve in a frustrating fourth set that featured eight breaks of serve.

He'd never lost to Almagro in 12 previous meetings and, as the No. 1 Spaniard in the draw in the absence of 11-time major winner Rafael Nadal, felt a responsibility to reach the semis.

"It was (a) miracle I won this match," Ferrer said of his comeback 4-6, 4-6, 7-5, 7-6 (4), 6-2 win. "I tried to fight every point; that's my game. I always fight."

Ferrer survived once in the third set and twice in the fourth when Almagro was serving for the match, but held his nerve and finally advanced to his third semifinal in the last four Grand Slam events.

"In the important moments, I played more consistent in my game," Ferrer said. "Of course, in the next round, the semifinals, I need to play my best tennis, better than today."

Djokovic acknowledged Ferrer's work ethic, saying the 30-year-old Spaniard was "one of the most respected guys on the tour because he never gives up."

"He plays every single match of his career with 100 percent," Djokovic said.

"I'm expecting a long one," he added.

Ferrer has never been past a major semifinal.

There are only three men left in the draw who have won Grand Slam titles ? Djokovic has won five, including the last two in Australia. He's aiming to be the first man in the Open era to win three consecutive Australian titles.

The other two are in action Wednesday, with 17-time Grand Slam winner Roger Federer against 2008 Australian finalist Jo-Wilfried Tsonga of France. Andy Murray, who broke the 76-year drought for British men at the major tournaments by winning the U.S. Open last year, will play Jeremy Chardy of France.

On the women's side, defending champion Victoria Azarenka faces Svetlana Kuznetsova, who has won the U.S. Open and the French Open, and 15-time major winner Serena Williams is against 19-year-old American Sloane Stephens, who is playing her first quarterfinal at a Grand Slam.

Maria Sharapova completed a career Grand Slam last year by winning the French Open, a few months after losing the Australian Open final to Azarenka. After her 6-2, 6-2 quarterfinal win over Ekatrina Makarova on Tuesday, she has conceded only nine games in five matches ? a record in Australia.

"To be honest, those are not the stats you want to be known for," Sharapova said.

DeKALB ? Everything and nothing changed Jan. 1 for Lisa Hardcastle.

When the new year came, Hardcastle was still the director of a home care division, but it was no longer for the DeKalb County Health Department. Instead, Hardcastle assumed the same position under the KishHealth System banner, completing a transfer of the program that had been discussed for months.

Some of the 16 home care employees laid off by the county, including Hardcastle, were hired by KishHealth System to create a seamless transition for the roughly 70 home care patients in the program. Hardcastle said it has been an exciting process moving from an agency with fewer than 100 employees to an organization with more than 1,500 employees and immense resources.

The potential for growth is starting to be realized, she said, with plans to expand to communities surrounding DeKalb and Sandwich. Hardcastle said there also are opportunities to integrate other hospital resources such as dietitians in the home care experience.

?Nursing is nursing is nursing no matter where you go and those core services are going to stay the same,? she said. ?But there are a lot more resources here at the hospital and the challenge now is learning to navigate that.?

Home care services provide skilled nursing, home health aides, physical, occupational and speech therapy, and medical social workers to those with chronic illnesses or who are recovering from surgery.

The county health department decided to end the home care program, which it had operated since 1966, to help reduce its deficit.

The program served 772 people in 2011 with county staff making 13,162 visits. It generated $1.9 million in fee revenue but ran a deficit. By shedding the program, the health department is expected to reduce its estimated deficit of $340,500 to about $56,500 in 2013.

Cost drivers such as cuts to Medicare compensation and changes to health care laws that hurt the county program are more easily absorbed by larger organizations, said Pam Duffy, president of KishHealth System?s home care division.

She said there has already been resource shifting to handle the cost of adding the program.

?We just have more resources,? she said. ?It?s a lot easier on us than a smaller facility.?

KishHealth System?s addition of the home care service also provides an opportunity for Kishwaukee Community Hospital and Valley West Community Hospital to reduce hospital admissions, which saves the patients and agency money, Hardcastle said.

Hardcastle, who also serves as president of the Illinois Home Care and Hospice Council, said a home visit is about $150 a day compared to the more than $1,000 a day for hospital and nursing home stays.

?There is such a push with health care reform ... to decrease hospital admissions,? she said. ?If we can prevent patients from going to the hospital that?s great. Home is where patients want to be.?

Stem cell research helps to identify origins of schizophrenia

Jan. 22, 2013 ? New University at Buffalo research demonstrates how defects in an important neurological pathway in early development may be responsible for the onset of schizophrenia later in life.

The UB findings, published in Schizophrenia Research, test the hypothesis in a new mouse model of schizophrenia that demonstrates how gestational brain changes cause behavioral problems later in life -- just like the human disease.

The genomic pathway, called the Integrative Nuclear FGFR 1 Signaling (INFS), is a central intersection point for multiple pathways of as many as 160 different genes believed to be involved in the disorder.

"We believe this is the first model that explains schizophrenia from genes to development to brain structure and finally to behavior," says lead author Michal Stachowiak, PhD, professor in the Department of Pathology and Anatomical Sciences in the UB School of Medicine and Biomedical Sciences. He also is director of the Stem Cell Engraftment & In Vivo Analysis Facility at the Western New York Stem Cell Culture and Analysis Center at UB.

A key challenge with the disease is that patients with schizophrenia exhibit mutations in different genes, he says.

"How is it possible to have 100 patients with schizophrenia and each one has a different genetic mutation that causes the disorder?" asks Stachowiak. "It's possible because INFS integrates diverse neurological signals that control the development of embryonic stem cell and neural progenitor cells, and links pathways involving schizophrenia-linked genes.

"INFS functions like the conductor of an orchestra," explains Stachowiak. "It doesn't matter which musician is playing the wrong note, it brings down the conductor and the whole orchestra. With INFS, we propose that when there is an alteration or mutation in a single schizophrenia-linked gene, the INFS system that controls development of the whole brain becomes untuned. That's how schizophrenia develops."

Using embryonic stem cells, Stachowiak and colleagues at UB and other institutions found that some of the genes implicated in schizophrenia bind the FGFR1 (fibroblast growth factor receptor) protein, which in turn, has a cascading effect on the entire INFS.

"We believe that FGFR1 is the conductor that physically interacts with all genes that affect schizophrenia," he says. "We think that schizophrenia occurs when there is a malfunction in the transition from stem cell to neuron, particularly with dopamine neurons."

The researchers tested their hypothesis by creating an FGFR1 mutation in mice, which produced the hallmarks of the human disease: altered brain anatomy, behavioral impacts and overloaded sensory processes.

"By attacking the INFS pathway, we were able to produce schizophrenia in mice," he says.

He adds that if such a generalized genomic pathway is causing the disease, then it should be possible to treat the disease with a more generalized approach. "We may even be able to devise ways to arrest development of the disease before it presents fully in adolescence or adulthood," he says.

The UB work adds to existing evidence that nicotinic agonists, often prescribed as smoking cessation drugs, could help improve cognitive function in schizophrenics by acting on the INFS. Schizophrenics smoke at a dramatically higher rate than the general population, long believed to be a form of self-medication.

In addition to NYSTEM, funding for the research was provided by UB and the March of Dimes and Birth Defects.

FORT BRAGG, N.C. (AP) ? An Army general brought back from Afghanistan to face court-martial on a series of sexual misconduct charges deferred entering a plea Tuesday.

Brig. Gen. Jeffrey Sinclair, who served five combat tours, is headed to trial following a spate of highly publicized military sex scandals involving high-ranking officers that has triggered a review of ethics training across the service branches.

Sinclair was arraigned Tuesday at Fort Bragg on charges that include forcible sodomy, wrongful sexual conduct, indecent acts, violating orders and adultery. When the judge invited Sinclair to enter a plea of guilty or not guilty, he deferred through his attorney, who indicated the general would enter his plea at a later date.

The hearing continued with a defense motion to disqualify prosecutors over privileged emails erroneously sent to them by criminal investigators. The messages included exchanges between Sinclair and his lawyers, his wife and with a family friend who is an ordained minister.

Lt. Col. Jackie Thompson, the lead defense attorney, urged the military judge overseeing the case to disqualify the entire prosecution team and order the case to be reinvestigated from scratch.

"We're not asking for a walk," Thompson told the judge. "We're asking for a case that is free of taint."

The military judge, Army Col. James Pohl, has set the trial portion of the court-martial for May 13. He did not immediately rule on the defense motion to disqualify the prosecuting attorneys, all four of whom testified under oath they had not reviewed the privileged emails.

A 27-year Army veteran, Sinclair faces life in prison if convicted on the most serious offenses. It's rare for an Army general to face court-martial. There have been only two cases in recent years.

More commanders have lost their posts over sex. Of the 18 generals and admirals, from one star to four stars, fired in recent years, 10 lost their jobs because of sex-related offenses.

That tally does not include retired Army general David Petraeus, who was forced to resign as CIA director in November after he admitted to an affair with the woman who wrote the biography of his military career. The investigation of Petraeus also ensnared Marine Gen. John Allen, the commander of U.S. forces in Afghanistan, over thousands of flirty emails he exchanged with a Tampa, Fla., socialite. On Tuesday, Pentagon officials said Allen had been cleared of inappropriate conduct.

At an evidentiary hearing for Sinclair in November, prosecutors presented testimony about his conduct with five women who were not his wife, including officers who served under his direct command. The charges involve activities when he was in Afghanistan, Iraq, Germany and at installations in the United States.

Sinclair was deputy commander in charge of logistics and support for the 82nd Airborne Division in Afghanistan before being relieved in May during the criminal investigation. He has been on special assignment since then at Fort Bragg in North Carolina.

The female captain at the heart of the case said she carried on a three-year sexual relationship with Sinclair, a father of two. Adultery is a crime under military law, and the admission could end her career.

She testified at the evidentiary hearing that she repeatedly tried to break off the affair with Sinclair, who she says threatened to kill her and her family if she told anyone about their frequent sexual liaisons in hotels, headquarters and war zones. The woman said she usually wanted to have sex with the general, though she said that on two occasions he exposed himself and physically forced her to perform oral sex, even as she sobbed.

The Associated Press does not publicly identify victims of alleged sexual assaults.

Two female officers who served with Sinclair also testified that they had given the general nude photos at his request.

Sinclair is also accused of possessing alcohol in a war zone and disobeying orders. Maj. Gen. James Huggins, Sinclair's superior officer in Afghanistan, testified he ordered Sinclair to cease contact with the female captain after she reported the affair. Sinclair is alleged to have willfully disobeyed that order by then calling the woman's phone.

Sinclair has not yet spoken publically about the charges against him. At the pretrial hearing, his defense lawyers conceded the affair with the female captain, while working to paint her as a liar trying to ruin the general's life and military reputation. During the hearings, they characterized her as a manipulative "back-stabber" who blamed others for her mistakes.

The general's wife, Rebecca Sinclair, has stayed away from court but went public with an opinion piece in The Washington Post. In that column, she said she was not condoning her husband's infidelity, but she said that a decade of war had taken a toll on military couples and brought pressure on their marriages.

In an interview with The Associated Press, Rebecca Sinclair said her husband called her last spring to tell her about the affair and allegations, and she said they were trying to mend their relationship.

A New York public relations firm, MWW, has been hired to represent Sinclair and is working to promote the claim he is being railroaded by overzealous prosecutors and a scorned lover.

A website launched Tuesday, www.sinclairinnocence.com , seeks to portray the general in a positive light while making public selected documents from the court files intended to undermine the credibility of the lead prosecutor and accuser.

Spokesman Josh Zeitz of MWW said the firm's fees are being paid for by the Sinclairs and a nonprofit legal defense fund established by the general's "friends and supporters." Zeitz said he could not disclose the identities of the contributors.

Can Apple maintain its shine?

(AP) ? For many investors, Apple's best days are behind it. Competitors are catching up, they believe, and the latest iPhone is stumbling.

The company's doubters have backed their conviction with billions of dollars. Last week, the stock fell below $500 for the first time in 11 months. Since Apple's stock peaked at $705.07 on Sept. 21 ?the day of the iPhone 5's release? it has fallen nearly 30 percent, cutting Apple's market capitalization by nearly $200 billion.

On Wednesday, Apple ?still the world's most valuable public company? gets a chance to rebut the skeptics as it reports financial results for the holiday quarter. But the report could also end up confirming beliefs that the company is losing its edge as an arbiter of innovation and a pacesetter in sales growth.

Apple's perception problem centers on the iPhone. Many investors believe the company has painted itself into a corner with the high-priced gadget. The iPhone is more expensive than other smartphones that do many of the same things. The company created the modern smartphone, but because of its strategy to sell the iPhone at a large premium, it will be unable to capitalize fully as smartphones continue conquering the world. The iPhone seems destined to remain the phone of the elite who can afford it.

In many ways, the iPhone's global battle with phones running Google's Android operating system is a replay of the Mac-PC battles of the 80s and 90s, when Apple saw its innovative-yet-expensive Mac outflanked by cheaper PCs running Microsoft's DOS and Windows software.

Analyst Michael Morgan at ABI Research believes Apple's share of the global smartphone market will grow from 20.5 percent in 2012 to 22 percent this year and then remain flat. Meanwhile, South Korea's Samsung Electronics ?the world's No. 1 maker of smartphones? is already at 30 percent of the market, and is set to leverage its chip- and display-making capabilities into further dominance, he said.

"Barring an unlikely collapse in Samsung's business, even Apple will be chasing Samsung's technology, software, and device leadership in 2013 ?through the foreseeable future," Morgan said.

Investors also see short-term difficulties for Apple. Last week, the Japanese newspaper Nikkei and The Wall Street Journal said the company has slashed its orders for iPhone 5 parts because the device isn't selling as well as hoped. Both publications cited unidentified people familiar with the situation.

Sterne Agee analyst Shaw Wu believes the press reports are misleading. IPhone 5 demand, he says, remains robust. He attributes the reports of lower orders to shifts to other suppliers and an improvement in production, which means fewer components are wasted while building the complicated phone.

Apple usually reports the number of iPhones it sells each quarter, so Wednesday's financial update should give investors some indication of where the company is heading. Analysts on average expect the company to show sales of 48 million iPhones, which compares with the 37 million it sold in the same period a year prior.

The wrinkle is that Apple doesn't break out how many iPhones it sells of each type ? it has kept selling the cheaper, two-year-old iPhone 4 and last year's 4S alongside the flagship 5.

A key tenet among investors who remain optimistic about Apple: Although the iPhone 5 is too expensive, buyers will shift their attention to the older Apple phones, which they find "good enough."

Analyst Andy Hargreaves at Pacific Crest Securities says demand for new iPhone models is going to falter. Last week, he downgraded Apple's stock from "Outperform" to "Sector Perform" because he believes consumers aren't going to clamor for new hardware features anymore. They'll hang on to older phones longer, and when they buy, they'll buy cheaper models, he says.

This means the total dollar value of the iPhones sold in the quarter may be more indicative than the number of phones sold. Analysts expect the sales were worth $30.8 billion in the quarter, or 56 percent of Apple's overall revenue. Deviations from this figure could cause big movements in the stock price.

There is renewed speculation that Apple could make a cheaper iPhone for the developing world, but most analysts believe the company will stick to its practice of keeping older iPhones in production and cutting their prices as new models come out. The problem is that the price cuts are relatively minor. A two-year-old iPhone 4 costs more than many new Android phones.

When reporting results for the July to September quarter three months ago, Apple shocked Wall Street by saying it expected earnings of just $11.75 per share for the October to December quarter. The company usually lowballs its estimates, but this was unusually far from the $15.59 per share average analyst estimate at the time. The reason, Apple said, was that it had so many new products coming out ? including the iPhone 5 and iPad Mini ? and fresh production lines are more expensive to run than mature ones.

Analysts then pulled back sharply on their estimates. Their average forecast is now $13.45 per share, according to FactSet.

In terms of sales, Apple said it expects to report about $52 billion in revenue, and analysts have wavered only slightly above that figure ? they now expect sales of $54.9 billion.

While Apple's future prospects are in doubt, the company's supporters have one strong argument in their favor: the stock is cheap compared to current earnings, and even if the iPhone's sales growth slows, Apple will continue to generate plenty of revenue. The stock trades at 11 times the past 12 months of earnings, compared with 15 for Microsoft Corp. and 22 for Google Inc. Those figures don't take into account Apple's enormous cash pile ?$121 billion? which boosts its value even further.

Despite its size, Apple's stock is no stranger to corrections. In 2008, in the midst of recession, Apple's stock fell by more than half, to under $100 per share. At the time, the iPhone was a year old and hadn't revealed its full potential.

It was only in early 2012 that its market capitalization decisively outgrew that of Exxon Mobil Corp., previously the world's most valuable company.

A smaller correction last year, also prompted by speculation about the future of the iPhone, took the stock down 16 percent before it rebounded.

"We believe investors that can look through this noise will be rewarded in 2013," said Brian White at Topeka Capital Markets. "The negative sentiment around the stock has reached epic levels that we haven't seen in recent memory and yet we believe the product portfolio has never been stronger."

Hundreds attend NYC memorial for Internet activist Aaron Swartz

Supporters of Aaron Swartz, the 26-year-old Internet activist who committed suicide last week, gathered in New York to remember the computer prodigy on Saturday, with some calling for changes in the criminal justice system they blame for his death.

Swartz, who at 14 helped create an early version of the Web feed system RSS and believed the fruits of academic research and other information should be freely available to all, was found dead a week ago in his Brooklyn apartment.

The city's chief medical examiner ruled the death a suicide by hanging.

He had been facing trial on federal charges he used the Massachusetts Institute of Technology's computer networks to steal more than 4 million articles from JSTOR, an online archive and journal distribution service.

Swartz, who had also worked on the popular website Reddit, had faced a maximum sentence of 31 years in prison and fines of up to $1 million.

"He told me about the 4.5 million downloads of scholarly articles, and my first thought was why isn't MIT celebrating this?" Edward Tufte, an emeritus professor of computer science at Yale University and a friend of Swartz, said to applause from the crowd gathered in The Cooper Union's Great Hall in Manhattan.

Taren Stinebrickner-Kauffman, Swartz's partner, criticized what she described as MIT's "indifference" to the saga, saying the school could have acted to end his prosecution.

The president of MIT said this week the school was investigating its role in Swartz's case. JSTOR has said in a statement it settled any dispute with Swartz in 2011 and praised his "important contributions to the development of the Internet."

Call?for change
At the memorial, attended by hundreds of friends and supporters, the strongest criticisms were reserved for prosecutors in the office of Carmen Ortiz, the U.S. Attorney for Massachusetts.

Roy Singham, the chairman of ThoughtWorks, a software consultancy firm where Swartz worked, called the case against Swartz "an abuse of state power" intended to intimidate Swartz. He called for the reform of the Computer Fraud and Abuse Act under which Swartz was prosecuted.

Swartz's partner said it all became too much for him to bear.

"He was so scared and so frustrated and more than anything so weary I just don't think he could take it another day," Stinebrickner-Kauffman said, adding the pair had discussed getting married after the trial.

Ortiz has defended her office's actions, saying prosecutors "took on the difficult task of enforcing a law they had taken an oath to uphold, and did so reasonably."

She said they offered Swartz a deal to plead guilty to multiple counts of wire fraud and computer fraud and spend six months at a low-security facility.

Swartz was remembered as a precocious talent who began addressing technology conferences as a teenager and whose quirks included being loath to wash his dishes and preferring bland foods like crackers and white rice.

Many speakers said he was by far the smartest and most intellectually curious person they had known, and called on those in attendance to continue his work of trying to widen the public's access to information and communication channels.

Stinebrickner-Kauffman said Swartz disliked grand ceremonies and would have been uncomfortable with some aspects of his own memorial.

"But memorial services are for the living," she said, repeating it several times like a mantra, "and last Friday he forfeited his right to decide that."
